SECTION 7. DATA RETENTION DURATION

Your Data is kept only for the time necessary for the purposes pursued as described in Section 4.

Access to the Site, intermediation and provision of Services	The Data collected for processing activities relating to access to the Site, the creation of Accounts and the provision of Services are kept for the duration necessary for the execution of the contract with GOTTEX.    They are then kept for five (5) years in secure archives for probative purposes.
Management and follow-up of the commercial transaction	The Data collected as part of the management and monitoring of the commercial relationship are kept for the duration necessary for the performance of the contract with GOTTEX.   They are then kept for five (5) years in secure archives for probative purposes.   Invoices and accounting data are kept for a period of ten (10) years.
Payment for Payment Products and Services	The User's payment data is deleted once the transaction has been completed, then kept in secure archives for a period of thirteen (13) months after the date of the transaction. With regard to payments made by credit card, this data may be kept as evidence if the transaction is disputed, in temporary files, for a period of thirteen (13) months (or fifteen (15) months if the payment is deferred) from the date the debit is made. In any case, the visual cryptogram is not concerned by this conservation, and the bank details are deleted on the expiry of the date indicated above.
Sending newsletters	The Data used in the context of sending newsletters and other alerts are kept for a period of three (3) years from the end of the commercial relationship if the User is a Client of the Operator. If the User is not yet a Client, the Data used in the context of sending newsletters and other alerts are kept for a period of three (3) years from the date of the last contact with GOTTEX. Thereafter, the User's Data is kept for a period of five (5) years, for the purposes of proof, in accordance with the provisions in force (in France, insurance code, mutuality code, commercial code, civil code, consumer code, internal security code, etc.)
Management of requests to exercise rights	Data relating to the management of requests to exercise rights is kept for the duration necessary to process the request. They are then archived for the duration of the applicable criminal statute of limitations in an intermediate archive.

• Droit de ne pas être soumis à une décision fondée uniquement sur un traitement automatisé (article 22 RGPD) ; aucune décision de ce type n’est actuellement appliquée par GOTTEX.

• Droit de définir le sort de vos Données après votre mort et de choisir que nous communiquions (ou non) vos Données à un tiers que vous aurez préalablement désigné (section 85 de la loi française sur la protection des Données). En cas de décès et à défaut d’instructions de votre part, nous nous engageons à détruire vos Données, sauf si leur conservation s’avère nécessaire à des fins probatoires ou pour répondre à une obligation légale.
